US :Request for Comments on Application of Countervailing Duty Law to Imports from the Mainland of China

The US Department of Commerce (DOC) published a notice in the Federal Register (FR) of 15 December 2006 to invite comments on the applicability of the countervailing duty (CVD) law to imports from the Mainland of China. Comments must reach the DOC within 30 days after publication of the FR notice, i.e. by 15 January 2007. The relevant FR notice (pdf format)  is appended for reference. 

DETAILS

  1. Commercial Information Circulars No. 438/2006 dated 7 November 2006 and No. 468/2006 dated 28 November 2006 reported the initiation of anti-dumping duty (AD) and CVD investigations by the US International Trade Commission (ITC) and the DOC against coated free sheet paper from the Mainland of China. In particular, the DOC noted that the CVD investigation requires a review of its long-standing policy of not applying the CVD law to non-market economies, including the Mainland of China, which is based on a court decision in 1986. In this connection, as part of the current investigation, the DOC will determine whether the CVD law should now be applied to imports from the Mainland of China, and given the complex legal and policy issues involved, the DOC invites comments on this matter.
