Mexico : New Labelling Requirements for Pre-Packaged Products

The Mexican Government published a notice in the Official Gazette on 6 November 2006 to set out its new labelling regulations for pre-packaged products. The new requirements will take effect from 5 January 2007. A copy (pdf format) of the gazette notice in Spanish is appended for reference.

DETAILS

  1. The Mexican Government has issued new labelling regulations to set forth the content, placement and dimensions of quantity information that must be borne by pre-packaged products, as well as the units of measure that must be employed. The stated purpose of these new requirements is to facilitate consumers to establish the relationship between the quantity and the price of pre-packaged products. Specifically, the regulations provide that the net quantity and drained quantity (if applicable) must be shown free of visual obstructions on the main display surface, and the dimensions of the quantitative data must be determined with regard to the area of the main display surface or the weight/volume of the net content. The requirements apply to all pre-packaged products except products commercialised in bulk, products sold in packages that enable the consumer to see the exact number of units therein, packages containing one unit, or packages showing a graphical depiction of the product, as long as the graphical depiction does not include products not in the package. For the purpose of the new regulations, a pre-packaged product is defined as a product which has been placed in a container when consumers are not present, and the quantity of the product cannot be altered without the container being opened or modified noticeably.
  2. As the requirements in the regulation are quite detailed and technical, traders are strongly recommended to seek clarifications with their importers in order to comply with the necessary requirements.
