US : Market Economy Inputs Practice in Antidumping Proceedings Involving Non-Market Economy Countries

Our Commercial Information Circular (CIC) No. 188/2005 of 31 May 2005 reported that the US' Department of Commerce (DOC) was considering options to change its current policy and practice regarding market economy input prices in proceedings involving non-market economies (NMEs). In response to the comments received on the options, DOC published a Federal Register (FR) notice on 11 August 2005 announcing a proposal to change the practice and inviting public comments. The details are contained in the FR notice appended (pdf format)  to this circular.

Details

  1. As highlighted in CIC No. 188/2005, when an NME producer sources a portion of an input from a market economy, DOC currently uses the average market economy input price to value all of the input in question in calculating the normal value, subject to certain conditions. One of the conditions is that the volume of the imported input as a share of total purchases from all sources must be "meaningful", which is determined on a case-by-case basis. Under the proposal, DOC will use the market economy purchase prices to value all of the input when the majority of each input by volume is sourced from market economies, provided that the other requirements are met. Where an NME producer sources less than a majority of the total volume of an input from market economies, DOC will weight-average the portion that is purchased from market economies, using the actual price paid, with the portion sourced domestically, using a surrogate value. DOC is seeking public comments on the proposal by 6 September 2005.
