Commercial Information Circular No. 119/2005

US : Separate Rates Practice and Application of Combination Rates in Antidumping Investigations involving Non-Market Economy Countries

Our Commercial Information Circular (CIC) No. 2/2005 of 3 January 2005 reported the US Department of Commerce's (DOC) provisional decision to adopt an application process for evaluating separate rate requests by non-investigated firms and to consider instituting combination rates for all firms receiving a separate rate in non-market economy (NME) cases. In this regard, the DOC announced in the Federal Register (FR) notice of 5 April 2005 that it is instituting two modifications (on separate rates and combination rates respectively) in its NME practice in antidumping investigations. A copy of the FR notice outlining the details is appended (pdf format) to this circular for reference.

  1. The two modifications are essentially in line with the proposals forwarded by the DOC in January 2005 as outlined in CIC No. 2/2005. A detailed explanation on these changes in practice can be found in Policy Bulletin 05.1 issued by the DOC (http://ia.ita.doc.gov/policy/bull05-1.pdf). The new practices are effective in all NME antidumping investigations initiated on or after the date of publication of the FR notice.
