US:Final Rule on Mandatory Advance Electronic Presentation of Cargo Information

 Revised Compliance Dates for Air Cargo Information

The trade was informed via Commercial Information Circular No. 304/2003 dated 15 December 2003 that the US Bureau of Customs and Border Protection (CBP) has adopted the final rule requiring mandatory submission of advance electronic cargo information on inbound and outbound air, sea, truck and rail cargoes by means of CBP-approved electronic data interchange system. The CBP announced in the Federal Register (FR) notice dated 4 March 2004 a revised implementation schedule for advance electronic transmission of inbound air cargo information. A copy of the FR notice is appended (pdf format) to this circular for reference.

DETAILS

  1. According to the FR notice, the CBP has set forth the revised implementation schedule in order to complete necessary modifications to the approved electronic data interchange system, train CBP personnel at affected ports and complete certification testing of new participants. The original compliance date of 4 March 2004 will be replaced by the following staggered implementation schedule -

Alabama, Arkansas, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana, Michigan, Minnesota, Mississippi, Missouri, Nebraska, New Mexico, Ohio, Oklahoma, South Dakota, Tennessee, Texas, Wisconsin

13 December 2004

Alaska, Arizona, California, Colorado, Hawaii, Idaho, Montana, Nevada, North Dakota, Oregon, Utah, Washington

Beginning on the dates set forth in the above implementation schedule, the CBP will require electronic transmission of advance information for any cargo that arrives in the US by air at a port of entry within one of the locations specified.
