Commercial Information Circular No. 171/02

US :New Regulations on Food and Drug Supply

The Food and Drug Administration (FDA) of the US Department of Health and Human Services promulgated in a letter that pursuant to the enactment of the Public Health Security and Bioterrorism Preparedness and Response Act of 2002 on 12 June 2002, FDA is required, amongst others, to :

  1. issue regulations requiring the registration of food facility including foreign one which manufactures, processes, packs, or holds food only if food from such facility is exported to the US without further processing or packaging outside the US;
     

  2. issue regulations requiring the keeping of records tracking the flow of the food supply;
     

  3. issue regulations requiring the provision of prior notice of food shipments into the US; and
     

  4. authorizes FDA to order the detention of food if authorized personnel finds evidence or information indicating an article presents a threat of serious adverse health consequences or death to humans or animals.

  1. FDA plans to publish the proposed regulations by the end of 2002 and plans to provide at least a 60-day comment period. In drawing up the proposed regulations, FDA is now seeking initial comments from interested parties on their concerns and potential options for addressing them.
