US : Final Rule on Origin Rules for Certain Textiles and Apparel

The trade was informed via Commercial Information Circular (CIC) No. 404/2008 of 5 August 2008 that the US Customs and Border Protection (CBP) had issued and invited public comments to the proposed change of origin rules for certain textiles and apparel. The final rule, effective on 3 October 2011, was published in the Federal Register (FR) on 2 September 2011. It is available at http://www.gpo.gov/fdsys/pkg/FR-2011-09-02/pdf/2011-22588.pdf.

2.CBP will adopt as a final rule the following two amendments to Title 19, Code of Federal Regulations, Part 102.21 to properly align the rules with the language of the underlying statute, 19 U.S.C. 3592:

  1. to amend the text in Part 102.21(c)(3)(ii) to ensure that fabrics of chapter 59, Harmonized Tariff Schedule of the United States (HTSUS), derive their country of origin from where the fabric is formed; and
  2. to amend the tariff shift rule in Part 102.21(e) for goods classified in headings 6210 through 6212, HTSUS, by creating a separate rule for heading 6212, which encompasses "brassieres, girdles, corsets, braces, suspenders, garters and similar articles and parts thereof, whether or not knitted or crocheted", to ensure that a knit-to-shape good of heading 6212 is found to derive its origin from where the good is knit to shape.

3.The FR notice is not adopting as a final rule those proposed amendments to the CBP regulations to establish uniform rules governing CBP determinations of the country of origin of imported merchandise.
