Notice to Exporters : Series 1 (USA) No. 2/2011

US : Final Rule on Country of Origin of Textile and Apparel Products

The trade was informed via Commercial Information Circular No. 409/2005 of 7 October 2005 that the US Customs and Border Protection (CBP) had issued and invited public comments to an interim rule entitled "Country of Origin of Textile and Apparel Products" to amend its regulations relating to the country of origin of textiles and clothing (T & C) products brought about by the elimination of T & C quotas as of 1 January 2005. The primary regulatory changes of the interim rule consisted of (i) the elimination of the textile declaration requirement; and (ii) the imposition of the manufacturer identification code (MID) requirement.

2.Based on the analysis of the comments received, CBP has determined to adopt the interim regulations as the final rule with the following two changes pertaining to the MID requirement:

  1. to limit the MID requirement to commercial importations of T & C products classified within Section XI, the Harmonized Tariff Schedule of the United States (HTSUS), and any 10-digit HTSUS number outside of Section XI with a three-digit textile category number assigned to the specific subheading; and
  2. to add a new example in the rules governing the construction of MID that illustrates the use of a post office box number as well as a manufacturer located in Kowloon, Hong Kong.

The final rule, effective on 17 March 2011, was published in the Federal Register on the same day. It is available at http://edocket.access.gpo.gov/2011/pdf/2011-6253.pdf.
