Transitional Arrangement for Exports of Textiles to Sensitive Markets

This notice informs traders, carrier and courier companies of the transitional arrangement in paragraphs 4-5 below for export of non-Hong Kong origin shipments to sensitive markets on or before 16 January 2005.

  1. As announced in Notice to Exporters: Series 1 (USA) No. 43/2004, Series 2 (EU) No. 33/2004, Series 3 (Countries other than USA & EU) No. 30/2004, Certificate of Origin Circular No. 14/2004, Import Licensing (Textiles) Circular No. 2/2004 cum Textiles Trader Registration Circular No. 10/2004 all dated 30 November 2004 on Textiles Control Arrangements for 2005, traders registered under the Textiles Trader Registration Scheme (TTRS) may cover exports of textiles to the Mainland or to economies which have applied safeguard measures on the Mainland, currently the USA, either by Export Notification I (EN I) (for goods of Hong Kong origin) or Export Notification II (EN II) (for goods of non-Hong Kong origin) as appropriate.]
  1. For the purpose of completing EN I, textiles traders must provide the particulars and declaration of the manufacturer of the goods in respect of which the notification is lodged. For textiles products purchased locally of which the manufacturers cannot be identified, textiles traders may make use of EN II to cover the subject consignments. In this connection, textiles traders should take note of the following when completing EN II.
  1. The following declaration should be made in the 'Full Description of Goods' column -

"Goods are purchased from :
Name of company and address : XXXXX
Telephone No. : XXXXXXXX
Invoice No. XXXX"

  1. For paper EN II, the 'Country of Origin' and 'Import Notification (Textiles) / Import Licence (Textiles) No.' fields in the Exporter's Declaration box should be left blank.
  1. For electronic submission of EN II, traders should select [countries / territories, not elsewhere specified] for 'Country of Origin' (i.e. from among Codes 9O-9V) and input the subject invoice no. into the field of Import Notification (Textiles) No.
  1. Hard copy of the invoice needs NOT be attached to the EN II lodged either via the paper or electronic mode.

Transitional Arrangement

  1. The Department is aware that some traders may have inadvertently lodged an EN I without providing the requisite particulars and declaration of the manufacturer for the time being. In order to provide greater facilitation to the textiles trade and other related business sectors, the Department will, on an exceptional basis, implement a transitional arrangement whereby EN I without manufacturer's particulars and declaration may be accepted for shipments that are to be effected on or before 16 January 2005, provided that the exporter will duly complete an EN II for the shipment concerned with the correct declaration as specified in paragraph 3 above.
  1. The exporter concerned should return the duly completed EN II, together with photocopy of the Exporter's Copy of the subject EN I, to the Trade and Industry Department within 14 calendar days after the date on which the goods are exported in the following manner:
  1. by post to the Customer Service Centre of Textiles Controls Branch, 2/F, Trade and Industry Department Tower, 700 Nathan Road, Mongkok, Kowloon; or
  1. by drop-in at the drop-in box inside the Customer Service Centre of Textiles Controls Branch, 2/F, Trade and Industry Department Tower, 700 Nathan Road, Mongkok, Kowloon.
  1. Please note that the transitional arrangement is implemented on an exceptional basis and will not be extended after 16 January 2005.
