USA :Amendment of Rules of Origin for Certain Textile Products

 

The US has introduced certain amendments to the rules of origin stipulated in Section 334(b)(2) of the Uruguay Round Agreements Act (19 U.S.C. 3592 (2)) for non-wool fabrics, certain flat goods and made-up articles, via the Trade and Development Act of 2000 enacted on 18 May 2000. As a result of the amendment, either fabric forming or printing and dyeing plus two or more specified finishing processes will be regarded to confer origin for imports of the relevant products into the US. DETAILS

Effective from 18 May 2000, imports of non-wool fabrics and certain flat goods and made-up articles (except those of cotton, cotton blends containing 16% or more by weight of cotton, or wool) will be subject to the following revised origin rules:

  1. For fabrics of silk, cotton, man-made fibre or other vegetable fibre, the country of origin will be either where the fabric is formed or where it is both dyed and printed when accompanied by two or more of the following finishing operations: bleaching, shrinking, fulling, napping, decating, permanent stiffening, weighting, permanent embossing, or moireing.

  2. For certain flat goods and made-up articles (excluding products of cotton, of cotton blends containing 16% or more by weight of cotton, or of wool) listed in the Appendix, the same rule above also applies.
   
3. Notwithstanding the above changes, imported wool fabrics and similar flat goods and made-up articles (of cotton, cotton blends or wool) as those listed in the Appendix will continue to be subject to the existing origin rules as repeated below:
  1. For wool fabrics, the country of origin is the place where the fabric is formed by a fabric-making process.

  2. For bedlinen, handkerchiefs, scarves and other made-up articles as set out in the Appendix but are composed of cotton, cotton blends or wool, the country of origin is the place where the fabric comprising the good is formed by a fabric-making process.
