Prohibition
on Transfer of Licences
Importers and exporters
are reminded that licences issued by the Department are not transferable.
- Any person who
deliberately supplies false or misleading information on a licence application
or declaration commits an offence under Section 36(1) of the Import
and Export Ordinance. This would include a person who declares himself
to be the importer or exporter on the licence application with a view
to transferring the licence issued to another person. If found guilty
of such an offence, a person would be liable to a fine of HK$500,000
and to imprisonment for two years.
- Moreover, the import
or export of textiles other than under and in accordance with a valid
licence issued by the Director-General of Trade is an offence under
Sections 6C and 6D of the Import and Export Ordinance, unless the importer/exporter
is a registered textiles trader under the Textiles Trader Registration
Scheme (TTRS) and has been granted exemption from licensing requirements
in respect of certain textile articles under the Import and Export (General)
Regulations. For details of the TTRS, please refer to Textiles Trader
Registration Circular No. 3/96. Copy of the circular may be obtained
from counters nos. 1 - 2 on 1/F, Trade Department Tower while stock
lasts. A copy of the circular is also available in Trade Department
Library on 17/F, Trade Department Tower for traders' reference. Traders
who are interested in participating in the TTRS may contact Mr K T Lee
of Non-restrained Textiles Section of Trade Licensing Branch at 2398
5476 for details.
- A licence is issued
direct to the importer or exporter and not to any other person; and
it can only be used by the person declaring himself to be the importer
or exporter on the licence application concerned. Any person found guilty
of breaching these regulations would also be liable to a fine of HK$500,000
and to imprisonment for two years.
- Importers and exporters
should apply for the required licences themselves, and licence applications
should be submitted direct to the Trade Department.
