Trade and Industry Department Circular

UNITED NATIONS SANCTIONS (SUDAN) REGULATION 2013; AND UNITED NATIONS SANCTIONS (SUDAN) REGULATION (REPEAL)REGULATION

This is to announce for general information that on 30 August 2013 the Government gazetted the United Nations Sanctions (Sudan) Regulation 2013 (the 2013 Regulation) (L.N. 145 of 2013) and the United Nations Sanctions (Sudan) Regulation (Repeal) Regulation (the Repeal Regulation) (L.N. 146 of 2013). Both the 2013 Regulation and the Repeal Regulation will come into operation on 6 September 2013.

2.The 2013 Regulation and the Repeal Regulation, made under section 3 of the United Nations Sanctions Ordinance (Cap. 537), implement sanctions against Sudan imposed by the United Nations Security Council under Resolution 2035 and previous Resolutions. The sanctions under the 2013 Regulation include:

  1. prohibition against the supply, sale, transfer or carriage of arms or related materiel to certain persons connected with Sudan;
  2. prohibition against the provision of assistance or training related to the provision, manufacture, maintenance or use of prohibited goods to certain persons connected with Sudan;
  3. prohibition against making available to certain persons or entities funds or other financial assets or economic resources, or dealing with funds or other financial assets or economic resources of certain persons or entities; and
  4. prohibition against the entry into or transit through the Hong Kong Special Administrative Region by certain persons.

WARNING

3.Contravention to the prohibitions imposed by the Regulation attracts substantial penalties which may amount in some cases to imprisonment for 7 years and/or a fine.

IMPORTANT NOTE

4.This circular is NOT a statement of the Laws of Hong Kong and has NO legal status. Anyone interested in the Regulation should refer to the Government Gazette for details. The prohibitions in the Regulation will apply to any person and company/registered business irrespective of and notwithstanding the possession of valid licences issued by the Director-General of Trade and Industry under the Import and Export Ordinance (Cap. 60) and its subsidiary legislation and other Enactments.
