(IRAN) (REPEAL) REGULATION 2016

UNITED NATIONS SANCTIONS
(JOINT COMPREHENSIVE PLAN OF ACTION-IRAN) REGULATION

This is to announce for general information that on 25 November 2016 the Government gazetted the United Nations Sanctions (Iran) Regulation (Repeal) Regulation (the Repeal Regulation) (L.N. 177 of 2016) and the United Nations Sanctions (Joint Comprehensive Plan of Action-Iran) Regulation (the JCPOA-Iran Regulation) (L.N. 178 of 2016).

2.The two regulations are made under section 3 of the United Nations Sanctions Ordinance (Cap. 537) to fully implement Resolution 2231 of the United Nations Security Council (UNSC). The Repeal Regulation repeals the United Nations Sanctions (Iran) Regulation (Cap. 537AF) to reflect UNSC's decision to terminate the provisions of previous UNSC Resolutions against Iran. The JCPOA-Iran Regulation implements a series of specific restrictions established by Annex B to UNSC Resolution 2231.

3.The restrictions under the JCPOA-Iran Regulation include:

  • prohibition against the supply, sale, transfer or carriage of conventional arms, nuclear-related item or ballistic missile-related item to Iran;
  • prohibition against the supply, sale, transfer or carriage of arms or related materiel or ballistic missile-related item from Iran;
  • prohibition against the provision of certain training, services or assistance related to conventional arms;
  • prohibition against the provision or transfer of certain assistance, training, services or resources related to nuclear-related items;
  • prohibition against the provision or transfer of certain technology, assistance, training, services or resources related to ballistic missiles;
  • prohibition against making available to certain persons or entities any funds or other financial assets or economic resources, or dealing with funds or other financial assets or economic resources of certain persons or entities;
  • prohibition against the sale and acquisition of interest in ballistic missile commercial activity or uranium commercial activity; and
  • prohibition against entry into or transit through the Hong Kong Special Administrative Region by certain persons.

4.An English version and a Chinese version of the UNSC documents relating to the Repeal Regulation and the JCPOA-Iran Regulation are available at the Information Counter on 1/F, Trade and Industry Tower for public inspection. These documents can also be found at UN website http://www.un.org.

WARNING

5.Contravention to the prohibitions imposed by the JCPOA-Iran Regulation attracts substantial penalties which may amount in some cases to imprisonment for 7 years and/or a fine.

IMPORTANT NOTE

6.This circular is NOT a statement of the Laws of Hong Kong and has NO legal status. Anyone interested in the Repeal Regulation and the JCPOA-Iran Regulation should refer to the Government Gazette for details. The prohibitions in the JCPOA-Iran Regulation will apply to any person and company/registered business irrespective of and notwithstanding the possession of valid licences issued by the Director-General of Trade and Industry under the Import and Export Ordinance (Cap. 60) and its subsidiary legislation and other Enactments.
