Rationalization of Licensing Arrangements

for Pharmaceutical Products and Medicines

Introduction

With effect from 16 September 2002, all import and export licences covering pharmaceutical products and medicines will be issued by the Department of Health under delegated authority of the Director-General of Trade and Industry under the Import and Export Ordinance (Chapter 60 of the Laws of Hong Kong). This circular announces the licensing arrangements after rationalization.

Current Arrangements

  1. Under the Import and Export Ordinance, all imports and exports of pharmaceutical products and medicines must be covered by import and export licences issued by the Trade and Industry Department.

  2. Currently, fresh licence applications covering imports or exports of pharmaceutical products and medicines are lodged and collected at the Pharmaceuticals Registration and Import/Export Control Section of the Department of Health (at 3/F, Public Health Laboratory Centre, 382 Nam Cheong Street, Kowloon). Such applications are endorsed by the Pharmacy and Poisons Board and further endorsed by the Trade and Industry Department.

  3. As regards requests for amendment and cancellation of licences after issuance, they are lodged and collected where appropriate at the Trade and Industry Department (at 12/F, Trade and Industry Department Tower, 700 Nathan Road, Mongkok, Kowloon).

New Arrangements

  1. In order to facilitate the trade and to streamline existing application procedures, with effect from 16 September 2002, the Department of Health will be the single government department to be responsible for the processing and approval of licence applications for imports and exports of pharmaceutical products and medicines as well as requests for amendment and cancellation under delegated authority from the Director-General of Trade and Industry.

  2. There is no change in the lodgement and collection arrangement of import and export licences of pharmaceutical products and medicines. They will continue to be lodged and collected at the Pharmaceuticals Registration and Import/Export Control Section of the Department of Health under para. 3 above. Approval licences will only bear the endorsement of the Pharmacy and Poisons Board and will not bear the endorsement of the Trade and Industry Department. Amendment and cancellation requests for all import and export licences will also be handled by the same office of the Department of Health with effect from 16 September 2002. Nevertheless, for amendment requests lodged before 16 September 2002, traders are reminded to collect the licences after amendment from the Trade and Industry Department.
